Terms and Conditions
Last updated: 8 September 2026
These Terms and Conditions govern your use of the ASAS platform — the mobile app, the vendor portal and this website. By creating an account or using ASAS you accept these terms. If you do not accept them, please do not use the platform.
1. Definitions
- "Platform" — the ASAS mobile app, the vendor portal, the administration portal and the underlying services.
- "Customer" — a user who publishes a plan, books a service or buys from the marketplace.
- "Provider" — an engineering office, contractor or company that offers services through the platform.
- "Vendor" — a seller of materials or products through the marketplace.
- "Plan" — a project a Customer publishes, with its drawings, scope, budget, timeline and site location.
- "Proposal" — an offer a Provider submits against a Plan, stating price and delivery time.
- "Order" — a purchase of products from one or more Vendors through the marketplace.
2. What ASAS is — and is not
ASAS is a marketplace and an intermediary. We introduce Customers to Providers and Vendors, carry the messages and documents between them, and handle payment. We are not a party to the contract that results, we do not perform engineering, construction or delivery work ourselves, and we do not supervise it.
The agreement for any work or goods is between the Customer and the Provider or Vendor. Scope, quality, licensing, warranties, timelines and legal compliance are their responsibility. Verification badges and ratings shown on the platform are aids to your decision, not a guarantee by ASAS.
3. Eligibility and your account
- You must be at least 18 years old and legally able to enter into contracts. A business account must be opened by someone authorised to bind that business.
- A mobile number is verified by a one-time code before an account can be used, and each number may be linked to one account only.
- The information you give us must be true, current and complete, and you must keep it up to date.
- You are responsible for your password and for everything done through your account. Tell us immediately if you suspect unauthorised access.
- Providers and Vendors must supply valid licences and identity documents when asked, and may be restricted until those documents are approved.
4. Plans, proposals and invitations
- A Customer may publish a Plan to receive proposals from any eligible Provider, or assign it privately to Providers they invite. A Plan that is not open for proposals is visible only to the Providers invited to it.
- You must own the drawings, photos and documents you upload, or have the right to share them. Do not upload anything that infringes someone else’s rights.
- A Proposal is an offer by the Provider on the price and timeline stated. Either side may negotiate; the exchange is recorded on the Plan.
- A binding engagement arises when the Customer accepts a Proposal. From that point the agreed scope, price and timeline govern the work.
- Some Providers subscribe to a plan that limits how many proposals they may submit in a period. Reaching that limit does not affect proposals already submitted.
5. Site visits and bookings
- A Customer or a Provider may request a site visit. Where a fee applies, it is shown before you confirm and is payable through the platform.
- A site visit or a service booking is confirmed only once the other side accepts it. Either side may cancel before the scheduled time; a fee already paid is refunded or forfeited according to the cancellation rules shown at the time of booking.
- Attend the site safely and lawfully. ASAS is not responsible for anything that happens during a visit.
6. Marketplace orders and delivery
- Product descriptions, prices, stock levels and delivery fees are set by the Vendor. Prices are in Kuwaiti Dinar and include the fees shown at checkout.
- An order is accepted when the Vendor confirms it. If an item turns out to be unavailable, you may be offered a replacement, a partial fulfilment or a refund of that item.
- Delivery is made to the address you provide. Give an accurate address and a reachable number; failed deliveries caused by wrong details may still be charged.
- Check the goods on delivery and report shortages or damage promptly so the Vendor can put it right.
7. Payments, escrow and payouts
- Payments are taken through our payment gateway by KNET, credit or debit card, or Apple Pay. Card details are entered on the gateway’s secure page and never reach ASAS.
- Where the service requires it, the amount you pay is held in escrow and released to the Provider or Vendor once the work or delivery is confirmed complete, less any platform fee disclosed to them.
- Provider and Vendor earnings accumulate in a wallet and are paid out to the bank account registered on the account. Keep those details accurate — we are not responsible for a transfer sent to details you gave us in error.
- A refund is returned by the same method used to pay, and may take several business days to appear depending on your bank.
- You are responsible for any taxes or duties that apply to you.
8. Cancellation, completion and disputes
- A Customer may cancel a Plan before a Proposal is accepted. After acceptance, cancellation is governed by what the two sides agreed and by the cancellation rules shown in the app.
- When a Provider marks work complete, the Customer has a review window in which to confirm it or raise a dispute. If the window passes without an objection, the work is treated as accepted and funds are released.
- A dispute is reviewed by ASAS on the evidence both sides submit. We may hold funds until it is resolved, and our decision on the release of funds held on the platform is final for that purpose. This does not limit either side’s right to pursue the matter legally.
9. Reviews, chat and conduct
- Reviews must reflect a genuine experience. Fake, paid or retaliatory reviews may be removed and the account restricted.
- Chat is for the transaction at hand. Either side may block the other, and blocking stops messages in both directions.
- You may not use the platform to break the law, to harass or defraud anyone, to circumvent platform payments, to scrape or copy content, to upload malware, or to attempt unauthorised access to our systems.
- Taking a transaction off the platform to avoid fees removes your protection: escrow, dispute resolution and refunds apply only to payments made through ASAS.
10. Content and intellectual property
The drawings, files and text you upload remain yours. You grant ASAS a licence to store, display and transmit them as needed to run the service — including sharing a Plan with the Providers entitled to see it. The platform itself, its software, design and trade marks belong to ASAS and may not be copied or reused without our written permission.
11. Suspension, termination and deletion
- We may suspend or close an account that breaches these terms, that is used fraudulently, or that we are legally required to restrict.
- You may delete your account at any time from Settings in the app or at asasapp.net/delete-account. Deletion is permanent.
- Deleting an account does not cancel obligations already incurred: work under way, an unpaid balance, an open order or an open dispute survive deletion and must still be settled.
12. Disclaimers and liability
The platform is provided on an "as is" basis. We do not warrant that it will be uninterrupted or error-free, and we give no warranty about the quality, safety, legality or timeliness of any service or product supplied by a Provider or Vendor.
To the extent permitted by law, ASAS is not liable for indirect or consequential loss, loss of profit, or loss arising from the acts or omissions of a Provider, a Vendor or another user. Where liability cannot be excluded, it is limited to the platform fees you paid to ASAS on the transaction concerned.
You agree to indemnify ASAS against claims arising from your breach of these terms or from content you upload.
13. Changes to these terms
We may update these terms as the platform develops. The revision date at the top of this page shows the current version. Continuing to use ASAS after a change means you accept the updated terms.
14. Governing law
These terms are governed by the laws of the State of Kuwait, and the courts of Kuwait have jurisdiction over any dispute arising from them.
